Acceptance of Terms
By accessing this website or engaging gitworkdone for services, you agree to be bound by these Terms of Service. If you do not agree, please do not use this site or our services.
These terms apply to the gitworkdone.com website and all web design, development, and related services provided by GitWorkDone LLC ("we," "us," or "our"), to clients ("you").
Services
gitworkdone provides freelance web design, development, and related digital services. The specific scope, deliverables, timeline, and pricing for each engagement are defined in a written proposal or project agreement provided before work begins.
We reserve the right to decline any project at our discretion. Acceptance of a proposal does not guarantee project commencement until the deposit has been received.
Payments
All projects require a non-refundable deposit before work begins. The deposit amount is specified in your project proposal. Work does not start until the deposit is received and confirmed.
The final balance is due and must be paid in full before the final deliverables are transferred or the site is launched. Files and source code remain the property of gitworkdone until full payment is received.
All payments are processed securely through Stripe. By submitting payment, you agree to Stripe's terms of service. We do not store your payment information.
Invoices unpaid beyond 30 days of the due date may incur a 1.5% monthly late fee.
Intellectual Property
Upon receipt of full payment, you own the final website deliverables — design files, code, and content we created specifically for your project.
gitworkdone retains the right to display the completed work in our portfolio, case studies, and marketing materials unless you request otherwise in writing before the project begins.
We do not transfer rights to any third-party tools, fonts, plugins, stock images, or software used in your project — those remain subject to their respective licenses. We will document any licensed assets included in your project.
Any content you provide to us (text, images, logos, brand assets) remains your property. You represent that you have the rights to use any content you submit.
Revisions
The number of included revision rounds is defined in your project proposal. Revisions are changes to agreed-upon work — they are not new features or scope changes.
Additional revisions or scope changes beyond what is included in the proposal will be billed at our current hourly rate or quoted as a change order. We will notify you before any additional charges are incurred.
Client Responsibilities
Timely project completion depends on you providing feedback, content, and approvals within agreed timelines. Delays caused by late client feedback may push back the project timeline accordingly.
You are responsible for ensuring that any content, copy, images, or other materials you provide do not infringe on third-party rights, violate any laws, or contain false or misleading information.
SMS Text Alert Program
By submitting your mobile number and checking the consent box on our SMS Text Alert Subscription form (available at gitworkdone.com/sms-alerts), you expressly consent to receive recurring automated marketing and informational text messages from GitWorkDone LLC at the mobile number you provide, including messages sent using an automatic telephone dialing system. Consent to receive text messages is not a condition of purchasing any goods or services.
Message types may include project updates, appointment and call reminders, preview and proposal notifications, and occasional promotional offers. Message frequency varies and may be up to approximately four (4) messages per month.
Message and data rates may apply, depending on the terms of your mobile carrier plan. You are solely responsible for any charges billed by your wireless provider.
You can cancel the SMS service at any time by replying STOP to any message you receive from us. After you send STOP, we will send a one-time confirmation message, and you will no longer receive SMS messages from us unless you re-enroll. To re-subscribe, sign up again at gitworkdone.com/sms-alerts. For help at any time, reply HELP or email design@gitworkdone.com.
Text messages are sent on our behalf by our messaging provider, Twilio, under its applicable terms and privacy policy. Carriers (including, but not limited to, T-Mobile, AT&T, and Verizon) are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless service provider and is not guaranteed.
You represent that you are at least 18 years old and that you are the account holder of, or are authorized by the account holder to enroll, the mobile number provided. You agree to notify us promptly if you relinquish, change, or deactivate that mobile number.
Mobile opt-in information and phone numbers collected through this program are handled in accordance with our Privacy Policy. We do not sell or share mobile opt-in consent data or phone numbers with third parties or affiliates for their own marketing or promotional purposes.
GitDial SMS Text Alert Program
This section applies specifically to text messages sent through GitDial, an AI voice-receptionist product operated by GitWorkDone LLC on behalf of its small-business clients.
GitDial sends transactional text messages only — appointment confirmations and callback requests tied to a specific phone call. These messages are never used for marketing or promotional purposes and are never sent on a recurring basis.
Consent to receive a GitDial text message is given verbally by the caller during a live phone call with a GitDial-powered AI agent, as described in full at gitworkdone.com/sms-consent. Consent to receive a text is not a condition of receiving service from the business the caller contacted.
Message and data rates may apply. Reply HELP for help or STOP to opt out of future messages at any time. Message frequency: one message per call or appointment.
Limitation of Liability
gitworkdone is not liable for any indirect, incidental, consequential, or punitive damages arising from our services, including but not limited to lost revenue, lost data, or business interruption.
Our total liability to you for any claim arising from our services is limited to the total fees paid by you for the specific project giving rise to the claim.
We make no guarantees regarding specific business outcomes, search engine rankings, conversion rates, or revenue resulting from your website.
Governing Law
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes arising from these terms or our services shall be resolved in the courts of Fulton County, Georgia.
Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
